These Terms of Service ("Terms") govern your use of the website at darkopalsolutions.com (the "Website") and the free sample service offered by Darkopal Solutions Unipessoal Lda. ("Darkopal Solutions", "I", "me", "my").

By using the Website or submitting the free sample request form, you agree to these Terms. If you do not agree, please do not use the Website or submit the form.

1. Who I am

The Website and services are operated by Darkopal Solutions Unipessoal Lda. You can contact me at design@darkopalsolutions.com.

2. What I offer

Darkopal Solutions is a web studio that builds websites featuring AI-generated talking-head video clips, so that a business can present a real human presence on its site rather than a faceless page.

As part of this, I offer a free sample: if you submit the request form with a short video and photo of yourself, I will create a sample AI-generated talking-head clip so you can see what the result could look like for your own business.

The free sample is offered at my discretion. It is a demonstration, not a finished commercial product or a commitment to enter into a paid engagement.

3. The free sample

By requesting a free sample, you understand and agree that:

• The sample is provided free of charge and as-is, for demonstration purposes.
• I make no guarantees about the quality, accuracy, likeness, timing, or suitability of the sample for any particular purpose.
• I may decline to produce a sample, or stop producing one, for any reason — including if the material you submit is unsuitable, unclear, or violates these Terms.
• Turnaround time is not guaranteed.

4. What you must not submit

When you submit material to me, you confirm that:

• The video and photo you upload are of yourself, or you have the explicit permission of the person shown.
• You have the right to share the material with me and to allow me to use it to create your sample.
• The material does not contain anything unlawful, infringing, harmful, defamatory, or that violates the rights of any third party.
• You will not submit material depicting any person under the age of 18.
• You will not submit anyone else's likeness without their consent, or attempt to use my service to impersonate, deceive, or create misleading content about any real person.

You are fully responsible for the material you submit and for ensuring you have the rights to submit it.

5. Intellectual property and use of your material

• Your material remains yours. You retain ownership of the video and photo you upload.
• You grant me a limited permission to use that material solely to create and deliver your sample, and for no other purpose.
• I will not publish, share, or reuse your uploaded material for marketing or any other purpose without your separate, explicit permission.
• The sample clip I create, along with the Website's own design, content, avatar clips, code, and branding, remain the intellectual property of Darkopal Solutions unless otherwise agreed in writing.

6. Acceptable use of the Website

You agree not to:

• Use the Website for any unlawful purpose.
• Attempt to gain unauthorised access to the Website, its server, or any data stored on it.
• Interfere with or disrupt the Website or its security features.
• Use automated tools to scrape, copy, or harvest content or data from the Website.

7. Disclaimers

The Website and the free sample are provided "as is" and "as available", without warranties of any kind, whether express or implied. I do not warrant that the Website will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

8. Limitation of liability

To the fullest extent permitted by law, Darkopal Solutions will not be liable for any indirect, incidental, or consequential loss, or for any loss of profit, data, or business opportunity, arising from your use of the Website or the free sample.

Because the free sample is provided at no charge, my total liability in connection with it is limited to the maximum extent permitted by law.

9. Privacy

Your use of the Website and submission of the form are also governed by my Privacy Policy, which explains how I handle your personal data, including the video and photo you upload.

10. Changes to these Terms

I may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Portugal, and any disputes arising from them will be subject to the jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer protections available to you under the law of your country of residence within the EU.
